Welcome to Sirius Candle. These Terms and Conditions (“Terms”) govern your use of the website siriuscandle.com (the “Site”) and your purchase of any products from us. By accessing our Site or placing an order, you agree to be bound by these Terms.

We take pride in our candles, but please note:

Variations: Due to the nature of our products, slight variations in color, scent profile, and minor imperfections are normal and part of the product’s charm.
Accuracy: We strive to ensure all product descriptions, images, and prices are accurate. However, we do not warrant that the descriptions are entirely error-free.
Availability: All orders are subject to availability. We reserve the right to discontinue any product at any time.

4. Pricing and Payment

Prices: All prices are displayed in Euros (€). The prices shown on our website reflect the total amount payable at checkout. We reserve the right to adjust prices at any time without prior notice.
Payments: We accept payments via trusted third-party providers (PayPal and Stripe). By submitting payment details, you confirm that you are authorized to use the chosen payment method.
Order Acceptance: Your order is an offer to buy. A contract is only formed when we send you an email confirming that your order has been dispatched.

5. Shipping and Delivery

Regions: We currently ship exclusively within Malta and the European Union.
Carriers: We use MaltaPost and other trusted carriers for deliveries.
Timeframes: Delivery times are estimates. We are not liable for delays caused by the carrier or unforeseen circumstances.
Risk of Loss: The risk of loss or damage to the goods passes to you once the package is delivered to the address you provided.

6. Returns and the Right of Withdrawal

Under EU and Maltese consumer law, you have the right to cancel your order within 14 days without giving any reason.

The 14-Day Window: The cancellation period expires 14 days from the day you, or a third party indicated by you, acquires physical possession of the product.
Condition of Returns: To be eligible for a return, the product must be unused, unlit, and in its original packaging. We cannot accept returns on products that have been used, lit, or damaged after delivery.
Exclusions: Customized or personalized goods (such as candles with custom scents or custom labels) are strictly exempt from the right of return and cannot be refunded.
Return Costs: You are responsible for paying the return shipping costs unless the item arrived damaged or defective.
Refunds: Once we receive and inspect the returned item, we will process your refund via your original payment method within 14 days. If your full return is approved, this will include the cost of standard initial shipping.

7. Legal Guarantee of Conformity

Under EU and Maltese law, you are entitled to a statutory legal guarantee. If your products arrive damaged, defective, or not as described, please contact us immediately at [email protected] with photographic evidence so we can arrange a replacement or a refund.

8. Safe Use & Limitation of Liability

Please read this carefully. Candles are open flames and must be treated with respect.

Safety Instructions: You agree to follow all safety instructions provided on the product packaging. Always burn candles within sight, keep them away from drafts, pets, children, and flammable materials, and never leave a burning candle unattended.
Liability: To the maximum extent permitted by Maltese law, Sirius Candle shall not be liable for any indirect, incidental, or consequential damages, including but not limited to property damage or personal injury, arising from the misuse, improper handling, or failure to follow safety warnings associated with our products.

9. Events Outside Our Control (Force Majeure)

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control, including but not limited to postal strikes, severe weather, natural disasters, or severe disruptions to shipping networks.

10. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. We reserve the right to suspend or terminate accounts if we suspect fraudulent activity or a breach of these Terms.

11. Intellectual Property

All content on this Site including text, images, logos, and branding is the property of Sirius Candle and is protected by copyright and intellectual property laws. You may not reproduce or use our content without our explicit written permission.

If a dispute arises regarding your purchase, we encourage you to contact us first so we can resolve the issue directly.
